The agreement
These Terms of Use ("Terms") are an agreement between you and SOBR PTY LTD ("Folio", "we", "us") covering the Folio iOS app and the folioapp.info website (together, the "Service"). By creating an account or using the Service you accept these Terms and our Privacy Policy. If you don't agree, don't use the Service.
Where you download Folio from the Apple App Store, Apple's standard licensed application terms also apply, and Apple is a third-party beneficiary of these Terms with the right to enforce them.
Not medical advice
Reports are generated by AI from a photo and your answers. They are estimates expressed in cautious language, not facts about your health, and results vary with photo quality and lighting.
Eligibility
You must be at least 13 years old to use Folio. If you are under 18, you need the consent of a parent or guardian, who agrees to these Terms on your behalf. You must also meet the minimum age shown in the App Store listing for your region.
Your account
- Keep your sign-in credentials secure — you're responsible for activity on your account.
- Give us accurate information, and only upload photos of yourself (or of someone who has given you clear permission, such as a profile you manage for a family member).
- You can delete your account at any time in Settings; deletion removes your data as described in the Privacy Policy.
Your content
You own your photos and reports. You grant us a limited licence to host, process, and display that content solely to operate the Service — generating your reports, storing your history, and letting you export or share them. This licence ends when you delete the content or your account, except where retention is legally required.
We may use aggregated, de-identified information (never your photos, unless you have explicitly opted in) to improve the Service.
Subscriptions & purchases
- Folio offers auto-renewing subscriptions (currently $9.99/month or $69.99/year, in USD; regional pricing applies) and may offer one-time purchases. Prices are shown in the app before you buy.
- Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
- Free trials, where offered, convert to a paid subscription unless cancelled before the trial ends. Any unused trial portion is forfeited when you purchase a subscription.
- Manage or cancel in your device settings: Settings → your name → Subscriptions. Deleting the app does not cancel a subscription.
- Refunds are handled by Apple under App Store policies — request one at reportaproblem.apple.com. If a paid report generation fails on our side, we'll re-run it or credit you.
Acceptable use
Don't:
- Upload photos of another person without their clear permission, or any unlawful, harmful, or infringing content
- Use Folio to harass, discriminate, or make decisions about other people (employment, insurance, or similar)
- Reverse engineer, scrape, resell, or interfere with the Service, or probe its security
- Use automated tools to bulk-generate reports, or misrepresent Folio's output as a medical assessment
We may suspend or terminate accounts that break these rules.
Intellectual property
The Service — including the Folio name, wordmark, design system, report templates, and software — belongs to SOBR PTY LTD or its licensors and is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable licence to use the app on Apple devices you own or control, as permitted by the App Store terms. Your reports are yours to save and share.
Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We don't warrant that reports will be accurate, complete, or suit your skin, or that the Service will be uninterrupted or error-free.
Nothing in these Terms excludes rights that cannot be excluded under applicable law, including consumer guarantees under the Australian Consumer Law. Where liability cannot be excluded but can be limited, it is limited to re-supplying the Service or the cost of re-supply.
Limitation of liability
To the maximum extent permitted by law, SOBR PTY LTD will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total aggregate liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and AUD $100.
Termination
You can stop using Folio and delete your account at any time. We may suspend or terminate the Service or your access to it (with notice where practicable) for breach of these Terms, legal requirements, or discontinuation of the product. Sections that by their nature should survive — including content licences already exercised, disclaimers, and liability limits — survive termination.
Governing law
These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of its courts. If any provision is found unenforceable, the rest remain in effect. These Terms plus the Privacy Policy are the entire agreement between us about the Service.
